Payment Terms

The following terms (“Payment Terms”) govern payments made or received in connection with the services offered on or through www.worksplans.com or the Works Plans mobile application (the “Site”), operated by Works Plans LLC, located at 5830 E 2nd St, Ste 7000, Casper, Wyoming 82609, USA.

Works Plans LLC, referred to as “Works Plans, “we,” or “us,” provides these Payment Terms to ensure clarity and transparency in all financial transactions conducted on the Site.

By making or receiving payments for services on or through the Site, you accept and agree to be bound by these Payment Terms, whether on behalf of yourself, your employer, or any other entity (if applicable). These Payment Terms are supplemental to Works Plans’ General Terms of Service and Expert Terms of Service, as applicable (collectively, the “Terms of Service”).

Capitalized terms not defined herein shall have the meanings provided in the Terms of Service.

 

  1. Works Plans Balance:

The Works Plans Balance represents the aggregated amount of your Earnings as a Seller and/or returned payments from canceled Orders (or canceled Weekly Reports) as a Client.

 

  1. Payment Services Providers:

Payment Services Providers are third-party entities that facilitate payment transactions between Clients and Sellers on the Site. These services include collecting funds from Clients, remitting payments to Sellers, providing currency exchange services, and managing Works Plans Balance funds.

 

  1. Earnings:

Earnings refer to the funds Sellers earn on Works Plans, which can be withdrawn or used to purchase services on the Site, subject to these Terms.

2.1 General Payment Terms:

 

Standard Work Earnings
As a Seller, upon successful completion of each Order, your account will be credited with Earnings equal to 80% of the total purchase amount.

Hourly Contract Earnings:
For Hourly Contracts, your account will be credited with Earnings equal to 80% of the Hourly Rate for the total hours confirmed in each completed Weekly Report.

Payment Timing:
Works Plans credits Sellers once:

  1. An Order is completed, or A Weekly Report (for Hourly Contracts) is approved.
  2. Refer to the Orderssection in the Terms of Service for further details.

2.2 Cancellations:
If an Order or Weekly Report is canceled, all funds will be returned to the Client’s Works Plans Balance.

2.3Tax Obligations:
Sellers are solely responsible for:

  1. All applicable taxes (e.g., GST, VAT, income tax) under their jurisdiction
  2. Compliance with tax laws at all times. C Prices displayed on Work Pages, pages, or Logo Maker orders include all such taxes

 

2.4Limited Payment Collection Agency:

 Role of Works Plans
Sellers appoint Works Plans as their limited authorized payment collection agent exclusively to:

  1. Accept payments from Clients (via Payment Services Providers).
  2. Remit payments to Sellers as described in these Terms.

2.5 Payment Satisfaction

A Client’s payment obligation is fulfilled when Works Plans (via its Payment Services Providers) receives the funds.

Works Plans is responsible for forwarding payments to Sellers per these Terms.

 

2.6 Recourse Limitations
If Works Plans fails to remit payments, The Seller’s recourse is solely against Works Plans, not the Client.

 

2.7 Disclosure Rights:

Works Plans may reference these terms in:

  1. Service agreements
  2. Transaction receipts
  3. Compliance disclosures
  4. Other legal notices

2.8 Payment Services Disclaimer:

Works Plans is not a Payment Services Provider, All payment processing (collections, transfers, withdrawals) is handled by thirdparty Payment Services Providers

Sellers agree to comply with all additional terms imposed by these providers, which may be updated periodically.

3.1Withdrawal of Earnings:

Withdrawal Process:

Sellers may withdraw their Earnings using one of the approved withdrawal methods listed in Section 4 (Withdrawal Methods). To initiate a withdrawal:

  1. Navigate to the Earnings page for more information how to withdraw your earnings you can visit this page
  2. Select a designated withdrawal provider and follow the prompts.

3.2 Eligibility & Requirements.

  1. Payment Service Provider (PSP) Account:

You must maintain an active account with at least one of Works Plans’ designated Payment Services Providers.

Funds eligible for withdrawal will be held in trust by the PSP, not by Works Plans.

  1. Account Linking Restrictions:

Each Works Plans profile may link to only one (1) account per withdrawal method.

Each PSP account may be associated with only one (1) Works Plans profile.

3.3 Safety Clearance Period:

Standard Sellers: Earnings become available for withdrawal 14 days after Order completion.

Top Rated Sellers: Earnings become available 7 days after Order completion.

Hourly Contracts: Earnings from Weekly Reports become available 7 days after approval.

3.4 Withdrawal Restrictions:

Works Plans reserves the right to temporarily suspend withdrawals if:

Required by law or to prevent fraud.

Security issues or improper conduct are detected (e.g., multiple accounts linked to one PSP).

Necessary to protect Works Plans or third-party interests.

3.5 Definitions:

Withdrawal Limits: Only available balances may be withdrawn.

Fees: Vary by withdrawal method (see Section 4.3) and are set by PSPs.

Irreversibility: Withdrawals are final and cannot be canceled once initiated.

3.6 Currency Conversion:

Withdrawals in non-USD currencies are subject to exchange rates and fees by PSPs.

The USD value of your Works Plans Balance remains fixed; local currency equivalents fluctuate daily.

3.7 Disabled Accounts: Earnings may be withdrawn after 90 days, pending account verification and Works Plans’ approval.

Local Bank Transfer (LBT): $3 per transfer

A $3 transfer processing fee

A currency conversion fee (up to 2% of the transferred amount)”

 

5.1 General:

Clients pay for Works Plans to create Orders from a Seller’s Work Page, Custom Offer, For Hourly Contracts, expert Clients pay once a week, every Monday, for the Service detailed in the Hourly Weekly Report (for more information, see the Hourly Contracts section below). Works plans is not a Payment Service Provider. Works plans partners with Payment Services Providers for the purpose of collecting all payments from Buyers, transferring such payments from Buyers to Sellers, and holding funds in connection with works plans, Balances All payment services in connection with the collection of funds on the Site are performed by works plans Payment Services Providers and not by works plans.

Works Plans acts as the Seller’s limited authorized payment collection agent exclusively for the purpose of: (i) accepting payments from Client through its designated Payment Services Provider(s), and (ii) remitting such payments to Seller. The Client’s payment obligation to Seller shall be deemed fully satisfied upon Works Plans’ receipt of payment through its Payment Services Providers. Works Plans, via its Payment Services Providers, shall be solely responsible for transmitting funds to Seller in accordance with these Payment Terms. Should Works Plans, through its Payment Services Providers, fail to remit any such amounts to Seller, Seller’s sole recourse shall be against Works Plans and not against the Client directly. By accepting this limited agency relationship, Works Plans and its affiliates expressly disclaim any liability for Seller’s acts or omissions, For Hourly Contracts, Expert Clients are billed weekly.

 

5.2 Fraud Prevention and Payment Authorization

Data Collection for Security Purposes, Works Plans and its designated Payment Services Providers collect, and process payment information related to withdrawal transactions to:

  1. Prevent fraudulent activities
  2. Mitigate risks of unauthorized transactions (including money laundering)
  3. Address potential claims or liabilities
  4. Additional information may be collected as necessary to facilitate and secure payment processing. All data provided to Payment Services Providers is governed by their respective privacy policies and terms of service.
  5. User Representations and Warranties.
  6. By utilizing any payment method or submitting payment details on the Works Plans.

5.3 Acknowledgment and disclosure for payments:

Affirm your legal authority to  provide such payment information:

  1. Certify your lawful authorization to employ the designated payment method(s).
  2. If acting on behalf of an organization or third party, warrant that you possess valid authorization to use said payment method.
  3. Guarantee compliance with all applicable laws and regulations governing such transactions.

5.4 Compliance Obligations

All users acknowledge that Works Plans reserves the right to:

  1. Verify payment information through third-party services
  2. Suspend transactions pending additional authentication
  3. Report suspicious activities to relevant authorities as required by law

6.1 Accepted Payment Methods:
In most jurisdictions, Clients may complete purchases on Works Plans using the following payment options:

  1. Credit/debit cards
  2.  
  3. Local Bank Transfer (LBT).
  4. Works Plans Credits.
  5. Existing Works Plans Balance.
    Additional payment methods may be available in specific locations. Current payment options are detailed in our Payment Methods Guide here

6.2 Service Fee Structure
Standard Work Purchases:

  1. Service fee: 4% of transaction value (effective Jan 2025)
  2. Small order surcharge: $3 for purchases under 100$

               Hourly Contracts:

  1. Order Initiation Fee: $4 per contract (effective JAN 2025)
  2. Service fee: 4% of hourly rate
  3. All fees are clearly displayed during checkout prior to payment authorization.

6.3 Payment Protocols:

Available Works Plans Balance will be automatically applied to subsequent purchases.

All payments must be processed through the official Works Plans platform

Off-platform payment requests constitute a violation of our Terms of Service and should be reported immediately

6.4 Transaction & Electronic Documentation:
Client’s consent to electronic delivery of:

  1. Digital invoices
  2. Payment receipts
  3. Transaction records
    in PDF format via email or through the Works Plans platform.
  4. Expert Clients are billed weekly for hours reported in the Weekly Report.
  5. Weekly Reports are automatically submitted for review and marked as complete if not disputed within 72 hours.
  6. Disputes must address hours reported, not service quality.

7.1 Accepted Currencies:
Clients may complete transactions on the Platform using multiple currencies. For user convenience, displayed prices are rounded to the nearest whole number, The exact payment amount will be clearly shown at checkout prior to transaction confirmation.

7.2 Currency Conversion:
All foreign exchange services for local currency transactions are processed exclusively by our designated Payment Services Providers, not by Works Plans directly.
 When a selected payment method does not support the displayed currency, the transaction will be processed in USD regardless of the originally displayed currency.
The final charged amount will be explicitly disclosed in the actual transaction currency before payment authorization.

7.3 Hourly Contract Currency Terms:
The currency for Hourly Contracts is fixed upon contract initiation and remains constant for all subsequent payments.
The effective Hourly Rate may fluctuate based on prevailing exchange rates at each payment interval.

7.4 Pricing Basis:
All Platform prices originate from USD valuations.
Non-USD prices are subject to:

  1. Daily exchange rate adjustments.
  2. Potential conversion fees.
  3. Clients may elect to view and pay in USD by modifying their currency preferences.

7.5 Refunds and Cancellations:

 For transactions processed in non-USD currencies:

  1. Refund amounts will be calculated using the exchange rate effective on the cancellation date
  2. The refunded local currency amount may differ from the original payment.
  3. while preserving equivalent USD value

 

7.6 Works Plans Balance Valuation
       All Works Plans Balances are maintained in USD equivalents
       When viewed in alternate currencies:

  1. Displayed amounts may fluctuate daily with exchange rates.
  2. The underlying USD value remains constant.
  3. Users may toggle between currency displays at any time.

 

8.1Promotional Balance:

Works Plans may, at its sole discretion, issue promotional balance (“Works Plans Balance” or “Balance”) to eligible users. This Balance may be used solely for the purchase of Services offered through the Platform.

8.2 Balance Management:

  1. Balance Visibility: Your available Balance will be displayed in your account dashboard.
  2. Automatic Application: Valid Works Plans Balance will be automatically applied to your next qualifying purchase and reflected in your Order summary.

C.Expiration: Unless otherwise specified, Works Plans Balance expires three (3) months from the date of issuance.

             8.3 Terms of Use:

Non-Transferable: Balance may not be transferred, sold, or exchanged for cash or other consideration.

Non-Refundable: Balance has no cash value and cannot be refunded, including in cases of Order or Weekly Report cancellation.

Forfeiture: Unused Balance will be forfeited upon:

  1. Account deactivation or suspension by either the user or Works Plans.
  2. Expiration of the Balance validity period.

8.4 Program Modifications:

  1. Works Plans reserves the right to:
  2. Impose additional conditions or restrictions on Balance usage.
  3. Modify, suspend, or terminate the Works Plans Balance program at any time

without prior notice.

8.5 Misuse & Violations

Works Plans may avoid Balance in cases of:

  1. Fraudulent activity.
  2. Misuse or violation of these Terms of Service.
  3. Any attempt to manipulate or exploit the Balance system.

9.1 Promo Code Offers:

Works Plans may, at its discretion, issue promotional codes (“Promo Codes”) that provide special discounts on purchases of Works or other services offered through the Platform.

9.2 Promo Code Terms:

  1. Validity for Promo Codes are valid only for purchases on Works Plans.
  2. Each Promo Code will specify its expiration date and valid usage period.
  3. To apply a Promo Code, you must enter it on the checkout page before completing your purchase.
  4. Failure to enter the code during checkout will void the discount opportunity.

9.3 Usage Limitations:

  1. One-time Use for Each Promo Code may be used once per user account.
  2. Non-Stackable: Promo Codes cannot be combined with other promotions or discounts.
  3. Milestone Orders: For multi-stage orders, the discount applies only to the first
  4. Exclusions: Promo Codes cannot be applied to Works Plans Balance purchases.

9.4 Additional Conditions:

Works Plans may:

  1. Attach specific terms to individual Promo Codes, disclosed at issuance.
  2. Invalidate Promo Codes if fraud, misuse, or Terms of Service violations are detected.
  3. Modify or terminate the Promo Code program at any time without prior notice.

9.5 Important Disclaimers

  1. Promo Codes hold no cash value and cannot be redeemed for currency.
  2. Unused Promo Codes will expire automatically after their designated period.
  3. Works Plans reserve the right to revoke Promo Codes if terms are breached.

Works Plans may charge indirect taxes (e.g., VAT, GST) as required by law. Users are responsible for any applicable taxes in their jurisdiction.

11.1 Dispute Resolution Process:

We strongly encourage Clients and Sellers to first attempt to resolve any service conflicts directly through our Resolution Center. If a resolution cannot be achieved, or if you encounter prohibited platform usage, please contact Works Plans Customer Support for assistance.

11.2 Cancellation Basics:

Eligible Cancellations may be processed:

  1. Automatically Through the Resolution Center
  2. By Works Plans Customer Support
  3. Via Payment Services Provider intervention

11.2 Payment Disputes:

 Initiating chargebacks or payment reversals after order completion violates these Terms and may result in account suspension.

 11.3 Intellectual Property Rights:

  All IP transfers are contingent upon full payment, If payment is canceled:

  1. The Client forfeits rights to use delivered materials
  2. Funds will be returned to the Client’s Works Plans Balance

 11.4 Revisions Policy:

  1. Sellers determine revision allowances per their Work terms
  2. Revision requests must be made while the order is in “Delivered” status
  3. Abuse of revision requests (e.g., demanding extra unagreed work) is prohibited

11.5 Order Cancellation Scenarios

  1. A. Cancellations for Active Orders (Pre-Delivery)  may occur when:
  2. Seller is unresponsive >24hrs on late orders
  3. Either party demonstrates abusive behavior
  4. Copyright/TM violations are present
  5. Account deactivation occurs
  6. Cancellations for Delivered Orders (Pre-Completion), Cancellations apply when:
  7. Seller withholds final delivery to extend timelines.
  8. No deliverables matching requirements are provided.
  9. Seller demands additional payments.
  10. Client abuses revision system.
  11. Completed Orders May be canceled within:
  12. 14 days for standard orders.
  13. 7 days for Hourly Contracts, For cases involving with Verified IP infringement and Unauthorized commercial use

Works Plans advocates for Sellers in payment disputes

Recovered funds are returned to Seller earnings when possible

12.1 Refund Processing:

  1. Standard Refunds:

Canceled order funds return to Client Balance

Balance→payment provider refunds require manual request

  1. Partial Refunds:

Seller-initiated refunds are paid to original payment method

Fallback to Client Balance if provider refund fails

13.1 Modifications to Payment Terms

  1. Right to Amend Terms:
    Works Plans reserves the right to modify these Payment Terms periodically. Updated terms will be posted on this page with the effective date clearly indicated.
  2. Acceptance of Modified Terms:
    By continuing to use the Platform after any modifications take effect, you expressly agree to be bound by the revised Payment Terms. If you do not accept the changes, you must immediately discontinue using the Platform and may deactivate your account following the account termination procedures outlined in our Terms of Service.
  3. Reasons for Modifications:
    Works Plans may update these Terms to:
  4. Implement new product features or functionalities
  5. Comply with evolving legal and regulatory requirements
  6. Address security or fraud prevention needs
  7. Adapt to technological advancements
  8. Respond to circumstances beyond our reasonable control

 

               13.2 Governing Law and Jurisdiction:

  1. Applicable Law
    All claims arising from these Payment Terms regarding transaction processing – including both domestic (U.S.) and international card payments – shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of laws principles.
  2. Exclusive Jurisdiction:
    Any legal actions or proceedings related to these Payment Terms shall be brought exclusively in the state or federal courts located in Wyoming, and all parties irrevocably submit to the personal jurisdiction of such courts.

13.3 No Responsibility for Services or Payments:

Works Plans provides a platform for payment services but does not guarantee the performance, quality, or timeliness of services purchased by Clients.
